Terms of Service

Welcome to AuPear. These Terms of Service (“Terms”) govern your use of the AuPear application and website (the “Service”), operated by Tampa Trading Tribe LLC (“AuPear,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What AuPear does

AuPear helps you plan meals, build grocery lists, and compare prices across third-party retailers. AuPear is a planning and information tool. We do not sell groceries, fulfill orders, deliver products, or process retail payments. All purchases are completed directly with the retailer of your choice, subject to that retailer’s own terms, prices, and policies.

2. Prices, availability, and estimates

Prices, deals, delivery fees, and availability shown in AuPear are estimates gathered from third-party sources and may be inaccurate, outdated, or unavailable by the time you shop. Always confirm the actual price, fees, and total at the retailer before completing a purchase. AuPear is not responsible for differences between estimated and actual prices or for any retailer’s pricing or availability.

3. Recipes, dietary information, and allergies

Recipes, ingredient lists, and “foods to skip” preferences are generated with the help of automated systems (AI) and may contain errors or omissions. AuPear’s dietary and “foods to skip” features are conveniences, not safety guarantees. AuPear does not guarantee that any recipe or product is free of any allergen or suitable for any medical, dietary, or religious requirement. Always read ingredient labels and product information yourself, and consult a qualified professional for medical or dietary advice. AuPear is not a medical service and provides no medical advice.

4. Affiliate relationships

AuPear participates in affiliate and partner programs. This means we may earn a commission when you click certain links or complete qualifying purchases at third-party retailers, at no additional cost to you. Affiliate relationships do not change the price you pay. We aim to surface genuinely useful options, but you should make your own purchasing decisions.

5. Your account

You are responsible for activity under your account and for keeping your sign-in method secure. You must provide accurate information and be at least 18 years old (or the age of majority where you live) to use the Service. You may connect optional integrations (such as email receipt access); you can disconnect them at any time.

6. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, access it without authorization, scrape it, resell it, or use it to violate any law or any third-party’s terms. We may suspend or terminate accounts that violate these Terms.

7. Third-party services

The Service links to and interoperates with third-party retailers and providers. We do not control and are not responsible for third-party websites, apps, products, prices, or policies. Your dealings with any third party are solely between you and that third party.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, accurate, or error-free.

9. Limitation of liability

To the maximum extent permitted by law, AuPear and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service, third-party purchases, pricing differences, or reliance on any information provided. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars.

10. Changes

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
